Martinez originally filed for an appeal, claiming that the allegations had been proven wrong by an internal investigation, despite the fact that Martinez had received a formal reprimand and discipline for the actions.

Thanks for the clarification. I would like to believe that this ruling and the publicity that it has received would prevent him from practicing law anywhere in the US. I brought up the question of whether anybody had any idea about how long Jodi may have remaining on her state paid appeals before the clock runs out and that bill comes to her.

Btw, anyone know how the suit against Nurmi is going? How much is that estimated to cost? That is truly impressive and admirable. I too advised against the Martinez disbarment effort, on the grounds that it was very unlikely to succeed and funds were limited.

But I was wrong. The main remaining need is for more money for the future, privately funded appeals of her conviction. But there may be more in the future because Jodi said there are two other separate bar complaints on Martinez which may require pursuing in the future. How absolutely awesome of you Michael J. This is the opportunity, among other things, to present new evidence or allege ineffective assistance of counsel or judicial misconduct. It may take several years. If all state remedies fail, then Jodi must hire a private appeals lawyer to take her case into federal court. This begins with a habeas-corpus petition to the federal district judge.

If that judge does not grant relief, the case is appealed to the Ninth Circuit federal court of appeals. Only after all that could it end up with the US Supreme Court.

Oh no Lance, France is a mess already, and becoming worse, Covid wise anyway. France has like 4 or 5 times the Covid deaths of Germany which has around with a 80 million population, France 40 or 50 k deaths with a population of 70 million and the US k deaths with million citizens and even a way lower population density.. I will be the first to admit that I do not know criminal appeals law, even in my own state. I do know that clock is still ticking and Jodi and JAII need to come up with a plan to create reasonable doubt that would convince an appeals court that Jodi was telling the truth. There is no overwhelming evidence for 1st degree murder in that whole fucking case, just for J being the one who killed him eventually, however it came to that point.
